1. Who we are and scope of service

- Service provision: within the European Economic Area, mainly from Spain, with support laboratories currently located in Denmark and/or Spain.

- Languages: in case of discrepancy between versions in different languages, the Spanish version prevails.

3. Web Use and Responsibility

The user agrees to:

- facilitate truthful and updated data;

- do not introduce illegal content or malicious code;

- protect your credentials and, when available, enable two-step authentication;

- respect intellectual and industrial property rights;

- do not impersonate other people or advertise without permission.

We do not guarantee continuous availability or absence of errors. Except for fraud or gross negligence, our total liability for damages related to the Web or the service shall not exceed the price paid for the corresponding service (excluding taxes) and shall not cover indirect losses (loss of profits, loss of opportunities). Exclusions: nothing limits or excludes liability for death or personal injury caused by negligence, fraud or gross negligence, mandatory consumer rights or breach of essential obligations when it causes direct and foreseeable harm.

You may link to our homepage without framing, without using our branding without permission, and without suggesting sponsorship if it does not exist.

We may include links to third-party sites, the contents and policies of which we do not control or guarantee.

7. Products and functional scope

Starter

- Includes ancestry, traits, and wellness. Does not include health reports (predispositions), carrier status, or pharmacogenetics.

Advanced

- Includes the above and also multifactorial predispositions, carrier status in hereditary diseases, and pharmacogenetics.

- Based on microarrays with predefined markers.

ULTRA (Whole Genome Sequencing 30x)

- Sequence the whole genome (average coverage ~30x).

- Detects SNPs, indels, and in certain cases, some structural variants.

- Includes 12 months of full access with the tellmeGen+ subscription (see §8).

7.1 Hiring and Activation Requirements

Hiring limited to individuals over 18 years of age.

For minors or persons without capacity, hire and consent their legal representative with documentary accreditation.

We recommend activating and sending the sample within 12 months after purchase.

The sample must be sent from the same country of purchase; if this is not possible, contact us beforehand (costs or restrictions may apply).

7.2 Purchase process and confirmation

Before finalizing the purchase, we will inform you of all the phases and how to correct errors. After payment, you will receive a confirmation email with the order summary, instructions, and kit activation.

7.3 Delivery of Results

Delivery is made exclusively in digital format within your client area. Deadlines are approximate and depend on the volume of samples, quality controls, and technical capacity.

9. Right of withdrawal and returns (EU consumers only)

You have 14 calendar days to withdraw.

Legal exceptions:

- Unsealed hygiene or health items (e.g., saliva kits) cannot be returned.

- Services fully performed with your consent during the withdrawal period.

- Digital content not supplied on physical media, access to which has begun with your consent.

If the kit is still sealed, contact support and send it back within a maximum of 14 days from when you notify us of your withdrawal. We will refund payments (including, where applicable, standard shipping) within a maximum of 14 days. We may withhold the refund until we receive the kit or proof of shipment. Unless the product is defective, return costs are borne by the customer. The refund will be made by the same payment method, unless otherwise agreed.

10 bis. Guarantees and after-sales service

Physical kits are covered by the applicable legal guarantee of conformity. In Spain, the legal guarantee is 3 years from delivery; in other EU Member States, the legal guarantee established by their national legislation applies as a minimum. For digital content or services, we comply with the conformity and update rules of Directives (EU) 2019/770 and 2019/771, as per local transposition. This warranty does not affect your statutory consumer rights or any additional commercial warranties.

12. Essential Scientific Limitations and Warnings

Our reports are informative and educational in nature and are not a medical device for in vitro diagnostic use, nor do they replace medical judgment.

Genetic predisposition does not imply determination.

Scientific evidence is evolving; variants of uncertain significance are common in WGS.

Performance may vary depending on genetic ancestry.

We recommend independent genetic counseling in case of relevant doubts.

14. Other legal matters

- Assignment and subcontracting: we may work with suppliers that comply with applicable regulations.

- Partial nullity: if any clause is null, the rest remains in force.

- No waiver: that we do not exercise a right at one time does not imply future waiver.

- Force majeure: neither party shall be liable if a breach is due to events beyond its reasonable control.

- Alternative Dispute Resolution (EU): the ODR Platform stopped accepting new claims on 20/03/2025 and was closed on 20/07/2025. As alternatives, you can go to Consumer Arbitration Boards or mediation/arbitration bodies in your country, or to the competent European Consumer Centre. We will maintain updated ADR channels on the Web.

16. Governing law and competent courts

These Conditions are governed by Spanish law. For any dispute, and without prejudice to the inalienable rights of the consumer according to their domicile, the parties submit to the Courts and Tribunals of Valencia (Spain).
